Spring Green Energy Act

With Spring well under way, and the grass turning green, we think about the greening of our home too.

The Province of Ontario is proposing a Bill 150 in it's Green Energy Act.  

At present the Province is moving forward with mandating energy audits on Residential Homes, making it part of the Agreement of Purchase and Sale.  However Condominiums, commercial, and Industrial properties are excluded. The Bill stipulates that the Energy Audit must be done, but does not at this point indicate whose responsibility it is...the buyer or the Seller?  Furthermore it does not indicate what the acceptable levels are for energy efficiency in a home, and who has to bring the home to the acceptable levels...the Buyer or the Seller.? 

The Bill also does not address the houses that do not sell for many, many years, or change ownership within an estate portfolio. The home would have to sell thru a Realtor to have an energy audit.  

It appears the proposal will gain headlines but does not follow thru comprehensively. 

Once again , between land Transfer Tax, Toronto Land Trasnfer Tax, FINTAC/Money Laundering, Privacy legislation, Do Not Call Registry, the Federal and Provincial government forces the Realtor and lawyer, to be the police, tax collector and strong arm enforcer for their whimsical proposals.
